BYRD WATCHERS PET SITTING, LLC
SERVICE AGREEMENT
Byrd Watchers Pet Sitting, LLC agrees to provide Pet Sitting services to the Client and their pet(s) with the acknowledgement and acceptance of the following conditions. The terms of this Agreement shall apply to all Pets owned by the Client, at any and all locations authorized by the Client.
The Client guarantees that all Pet(s) to be cared for under this Agreement belong to the Client, and are not “visiting” Pet(s).
All Service Bookings are subject to a 50% Non-Refundable Deposit, based on the estimated total cost of the services to be provided. The full amount of the Deposit is payable at the time of Booking. The remaining 50% is due on the first day of Service. No refunds will be made for Client early returns.
Byrd Watchers Pet Sitting, LLC / Pet Sitter is under no obligation to perform any unpaid services. Failure to pay the full amount prior to the start of the Service Period may result in automatic cancellation of this Agreement.
Booking Reservations are Confirmed and Guaranteed ONLY when the required Deposit is paid in full. To be guaranteed that the Sitter will be available on the requested dates, the Deposit must be paid in full.
Client agrees to provide as much notice as possible if cancellation of any planned service is necessary. It is understood that a cancelled Booking leaves Byrd Watchers Pet Sitting, LLC / Pet Sitter with insufficient time to schedule a replacement Booking, which is very harmful financially. It is also unfair to other Clients, who may not have been served due to their requested dates being unavailable.
For Clients who Book Daily Pet Visits and/or walks, please provide as much notice as possible if cancellation of any planned service is necessary. Cancellations require at least 24 hours advance notice for each day. Example: Cancel 1 day requires at least 24 hours advance notice; Cancel 2 consecutive days requires at least 48 hours advance notice; Cancel 3 consecutive days requires at least 72 hours advance notice, etc. Clients who provide the required advance notice will receive a Credit toward future services.
Byrd Watchers Pet Sitting, LLC will be closed for New Year’s Eve, New Year’s Day, and May 12th through May 15th every year.
Holiday Bookings will include a $10 daily surcharge for all of the following days:
Valentine’s Day, St. Patrick’s Day, Fourth of July, and Halloween
Veterans Day if the day falls on a weekday, and Veterans Day weekend (Friday through Sunday) if the day falls on Thursday or Monday)
Thanksgiving Week (4-day minimum required)
Christmas Week (4-day minimum required)
A “Meet & Greet” between the Pet Sitter, Client, and Pet(s) is strongly recommended, so that the Pet Sitter is introduced to your Pet(s) as a Friend. A “Meet & Greet” is mandatory for any Pet(s) with guarding or protecting behavior. Meet and Greets are complimentary for first time Clients and first meetings with a new pet. A $20 charge will apply to additional meetings requested by the Client, and for key drop-offs/pick-ups by the Sitter.
10. The Client will safeguard the privacy of the Pet Sitter during the Service Period. Client shall notify the Pet Sitter of the existence of home security systems, and the placement of all surveillance devices. Client guarantees that no surveillance devices will be operating in areas where privacy is commonly expected and any areas permitted for the personal use of the Pet Sitter.
11. For the safety and security of the Pet(s), Pet Sitter and any potential visitors, the Client will notify anyone with keys to the residence that a Pet Sitter will be at the premises during the Service Period.
12. Once the Service Period begins, no one may enter the premises or remove the Pet(s) from the premises, unless the Client provides advance notice to the Pet Sitter in writing, text message, or email. Likewise, Clients returning home early are required to notify the Pet Sitter in advance.
13. Client shall notify the Pet Sitter in advance of any scheduled visitors, including service providers, expected to be at or in the premises during the Service Period. At the Client’s request, the Pet Sitter will be present for such visits.
14. Client agrees to remove or otherwise secure any valuables, medications, and private documents prior to the Service Period, and to lock or otherwise identify any areas of the premises that Client designates as off-limits to the Pet Sitter.
15. Byrd Watchers Pet Sitting, LLC / Pet Sitter shall not be held liable for damage to the home its contents, Pet(s), or others, unless such are caused by the sole gross negligence of the Pet Sitter, including but not limited to leaks, electrical problems, equipment or appliance malfunction, accidental breakage of fragile items, or acts of nature. If an issue occurs, Byrd Watchers Pet Sitting, LLC / Pet Sitter will diligently attempt to contact the Client before making a subjective decision on whether and how to deal with the problem. All repairs and related fees (including emergency service time and coordination fees to Byrd Watchers Pet Sitting, LLC / Pet Sitter) are the sole responsibility of the Client. Client agrees to fully pay or reimburse Byrd Watchers Pet Sitting, LLC within 10 (ten) calendar days of receipt of itemized expenses.
16. Byrd Watchers Pet Sitting, LLC / Pet Sitter shall not be held liable for any loss or damage to the home, its contents, Pet(s), or others in the event a visitor with keys enters the premises.
17. Byrd Watchers Pet Sitting, LLC / Pet Sitter shall not be held liable for any loss or damage in the event of a burglary, or other unauthorized entry or crime occurring during the Service Period.
18. The Pet Sitter will secure the home and keys to the home to the best of their ability during and at the end of each visit. While keys to the premises are in the possession of the Pet Sitter, they will be either on the Pet Sitter’s physical person, or will be properly stored at an alternate location specified by the Client.
19. Client is responsible for pet-proofing the house and yard, fences, gates, latches, and pet doors/doggy doors. Byrd Watchers Pet Sitting, LLC / Pet Sitter shall not be held liable for the absence, injury, death, or damages / fines related to any Pet(s) with unsupervised access to the outdoors.
20. Client is responsible for supplying the necessary equipment and supplies for the care of their pet(s), including but not limited to, a sturdy well-fit harness (halter, collar, etc.) for walks, or in the case of emergencies, firmly affixed vaccination tags, a lead rope or leash, pooper-scoopers and poop-bags, litter and litter boxes, food, treats, cleaning supplies, and medicines. Client authorizes any purchases determined necessary for the satisfactory performance of Pet Sitter’s duties. The Client agrees to repay Byrd Watchers Pet Sitting, LLC for any such items, plus service fees to Sitter for time spent obtaining items, within 10 (ten) calendar days.
21. The Pet’s comfort and safety are extremely important. It is understood that crated dogs are required to have a visit every 8 hours or less. Crated dogs 4 months old or less, as well as senior dogs with mobility issues, are required to have a visit every 4 hours or less.
22. The Client may authorize off-premises activities, such as visits to a designated dog park, for socialized, non-aggressive dogs. Authorization must be provided to Byrd Watchers Pet Sitting, LLC in writing, test message, or email.
23. Client shall defend and hold harmless Byrd Watchers Pet Sitting, LLC and the Pet Sitter from any and all expenses, damages, claims, fines, and fees (including attorney’s fees) resulting from illness or injury to the Pet, Pet Sitter or others, or damages involving or caused by the Pet(s), occurring at the premises or Client-authorized off-premise locations, including visits to a dog park.
24. The Pet Sitter is authorized to seek veterinary services and / or emergency veterinarian assistance as needed, at the sole cost of the Client, as further described in the Veterinary Release Agreement.
25. Everybody should have a back-up plan whenever possible. We suggest that all Clients make arrangements with someone to evacuate your Pet(s) in case of a weather-related crisis or disaster, or if you are unable to return as scheduled for any reason. Byrd Watchers Pet Sitting, LLC / Pet Sitter will definitely do all we can to see to your pet’s care and safety, if such an event occurs, but we cannot guarantee scheduled care if official local travel restrictions are in place, or in such case as your home is not accessible by car.
26. Byrd Watchers Pet Sitting, LLC / Pet Sitter agrees to provide the services described in this Agreement and related documents in a reliable, caring, and trustworthy manner. As a condition thereof, the Client expressly waives and relinquishes any and all claims against Byrd Watchers Pet Sitting, LLC and the Pet Sitter, except those arising directly from the sole gross negligence of the Pet Sitter. Byrd Watchers Pet Sitting, LLC and their Pet Sitters are insured under Pet Sitters Associates, Policy Number 69886.
27. Additional & Future Services: Byrd Watchers Pet Sitting, LLC is authorized to accept Client requests to modify the current Service Request plan, or accept new Service Requests, made in writing, by telephone, text, mail or email, and to enter my home to provide such services without additional signed written authorizations. All Service Requests, or modifications to Service Requests must be made to Byrd Watchers Pet Sitting, LLC. Pet Sitters are not authorized to accept or modify Service Requests directly.
28. Byrd Watchers Pet Sitting, LLC reserves the right to modify or change the terms and conditions of this Agreement as a result of new information received after this Agreement and associated documents are signed. Client agrees to any such modifications or changes, whether relayed to the Client in person, by telephone, text or email, or in writing.
29. Byrd Watchers Pet Sitting, LLC reserves the right to terminate services under this Agreement at any time if the Pet Sitter, in their sole discretion, determines that the Pet(s) pose a danger to the health or safety of itself, other pets, other people, or the Pet Sitter. In such instance, Byrd Watchers Pet Sitting, LLC / Pet Sitter will notify the Client soon as possible, whether prior to, or during the Service Period. If such concerns prohibit the Pet Sitter from caring for the Pet(s), the Client authorizes the Pet(s) to be placed in a kennel or other previously arranged location, with all costs, including but not limited to transportation, kenneling, and treatment being the sole responsibility of the Client.
30. A $45 Service Charge shall be assessed for each returned check. If a check is returned, checks will no longer be accepted from the Client.
31. In the event that Client fails to pay all amounts due to Byrd Watchers Pet Sitting, LLC in a timely manner, Client agrees to pay all costs and fees incurred in the collection of such funds, including attorney fees.
Client agrees to notify Byrd Watchers Pet Sitting, LLC of any complaints or concerns within 24 hours of the end of the Service Period.
Client attests that he / she has read this Agreement and associated documents in their entirety, and fully understands and accepts all terms and conditions therein.
